Terms and Conditions
These Terms and Conditions (“Terms”) govern participation in the Florentine Gold Affiliate Program (“Program”) operated by Florentine Gold (“we”, “us”, “our”). By applying or participating, you agree to these Terms.
1. Eligibility & Enrollment
To join the Program, you must:
- Be at least 18 years old
- Provide accurate and complete registration details
You are not required to have a website. Affiliates may promote via social media, email, messaging platforms, or other channels.
We reserve the right to approve, reject, or remove any affiliate at our sole discretion.
2. Independent Contractor Relationship
- You participate in this Program as an independent contractor, not as an employee, partner, or agent of Florentine Gold
- Nothing in this agreement creates any employment relationship, joint venture, or partnership
- You are solely responsible for how you promote Florentine Gold products
3. Tax Obligations (Australia)
- You are responsible for all taxes, reporting, and compliance obligations related to commissions earned
- If you are operating as a business in Australia, you may be required to provide a valid ABN (Australian Business Number)
- Florentine Gold does not withhold taxes on affiliate payments
4. Affiliate Tracking & Attribution
- Each affiliate will receive a unique referral link and/or coupon code
- Tracking is based on a 30-day attribution window
- If a customer clicks your link, you will be credited for purchases made within 30 days
Tracking depends on cookies and system attribution. We are not liable for lost commissions due to tracking limitations or user behavior.
5. Commission Structure
5.1 Commission Type
- Commission is calculated as a percentage of sale
5.2 Standard Commission
- Affiliates earn 10% commission on qualified purchases
5.3 First Order Bonus
- Affiliates earn 15% commission on the first purchase made by a new customer referred through their link or coupon code
5.4 Lifetime Commission
- Affiliates earn 10% commission on all future purchases made by the same customer (lifetime commission), provided the customer remains attributed to the affiliate within our system
5.5 Commission Conditions
Commissions are:
- Based on net order value (excluding shipping, taxes, discounts, and refunds)
- Only applicable to completed, paid, and non-refunded orders
- Voided for any canceled, refunded, or fraudulent transactions
6. Payment Terms
- Payments are issued via: Bank Transfer
We reserve the right to delay or withhold payments for fraud checks or disputes.
7. Prohibited Activities
Affiliates must NOT:
- Engage in spam or unsolicited promotions
- Make misleading or false claims
- Use unauthorized discount codes
- Impersonate Florentine Gold
- Bid on branded keywords without approval
- Self-refer purchases
- Use fraudulent traffic, bots, or fake accounts
Violation may result in termination and forfeiture of commissions.
8. Marketing & Brand Use
- Affiliates may use approved materials provided by Florentine Gold
- Branding must not be altered in a misleading way
- All intellectual property remains owned by Florentine Gold
9. Disclosure Requirement
Affiliates must clearly disclose their affiliate relationship in promotions in accordance with applicable laws and guidelines.
Example:
“This post contains affiliate links. I may earn a commission at no extra cost to you.”
10. Termination
We may terminate your participation at any time if:
- You breach these Terms
- You engage in fraudulent or unethical conduct
Affiliates may leave the Program at any time.
11. Limitation of Liability
Florentine Gold is not liable for:
- Indirect or consequential damages
- Tracking failures or platform issues
12. Modifications
We may update these Terms at any time. Continued participation constitutes acceptance of any changes.
13. Governing Law
These Terms are governed by the laws of Australia.
